Kate Steinle murder verdict sparks legislation to hold elected officials criminally responsible

Federal authorities have charged Jose Ines Garcia Zarate Tuesday with new immigration and gun violations less than a week after a San Francisco jury acquitted him of murder for the shooting death of Kate Steinle.

The Mexican national, Jose Ines Garcia Zarate, will face new immigration and gun charges. A San Francisco jury found him not guilty of murder on Thursday but he was found guilty of being a felon in possession of a firearm.

He now is in state custody on other charges, the Justice Department statement said, and faces a maximum penalty of 10 years in prison on the new counts.

Zarate is an undocumented immigrant and was deported five times ahead of the 2015 shooting.

The killing of Steinle became linked with the controversy over illegal immigration, and President Donald Trump referred to the case in pushing for stricter policies and in criticizing so-called "sanctuary cities". The bullet had ricocheted off the concrete walkway before striking Steinle, they pointed out.

The Immigration and Customs Enforcement Deputy Director Tom Homan slammed the city after Garcia Zarate's acquittal last week, saying the tragedy could have prevented if the city had complied with the agency's request to turn him in.

Jurors left court last week without speaking publicly about their verdict and Gascon said they have not spoken with prosecutors either.
