Radford, et al. v. Board of Education, et al. But the actual charges against him were for leaking sensitive information to the press from a closed door session of the board.
In December, Paladino told the local magazine Artvoice his greatest wish for 2017 is that Obama dies after he "catches mad cow disease after being caught having relations with a Herford", and that then-First Lady Michelle Obama returns "to being a male and let loose in the outback of Zimbabwe where she lives comfortably in a cave with Maxie, the gorilla". Respondent declined to answer whether he was aware of any board policy prohibiting the disclosure of confidential information, testifying that while he was "responsible to be aware of it", he was "n$3 ot specifically" aware of such a policy when he wrote the January 5, 2017 Artvoice article (Jun. 27, 2017 Tr. p. 283). But Board member Patty Pierce, a minority board member, had voted against resolutions. A federal lawsuit filed by Paladino against the board accuses members of attempting to stifle that right. Elia dismissed the other three. Acting as a Trump surrogate, he drew boos from leaders of the nation's largest school districts during a Florida conference in October, when he said Trump would dismantle "corrupted, incompetent urban school systems" and that the Common Core state standards were created by college professors who used to be "pot-smoking hippies". He had also said that he had no intention of resigning. The wealthy developer was elected to the school board in 2013 and re-elected by a narrow margin in 2016.
School Board President Barbara Nevergold did not immediately comment. While many of these themes would later appear in President Donald J. Trump's campaign, Mr. Cuomo trounced Mr. Paladino on Election Day.
The state's teachers union - New York State United Teachers - praised Elia's decision to remove Paladino.

However, the chief minister's office was informed through a letter that his speech would not be broadcast unless he "reshaped it", according to the report.
Vacco, who is the former State Attorney General, says he thinks Commissioner Elia's decision was politically motivated.
"He is getting punished for pulling the curtain back", said Vacco, who said Paladino was simply trying to reveal that the teachers union had "manipulated" the school board to "arrive at a budget busting contract".
Commissioner Elia found that Paladino did not prove that he was subjected to retribution from the board, and writes there is "no evidence" that his right to free speech has been "chilled or otherwise impaired".
