India may avail a "short extension" beyond 90 minutes to present its case, says ICJ Judge.
India also alleged that "it was not informed of Jadhav's detention until long after his arrest", and learned about the death sentence through the media.
World renowned sand artist Sudarsan Pattnaik on Monday carved a larger-than-life sculpture of Indian national Kulbhushan Jadhav at Puri beach in Odisha to seek justice for the former Navy officer.
However, Jadhav was not granted consular access by Pakistan despite repeated requests by India. He said that Jadhav "is a terrorist" and "India invoked the jurisdiction of this court improperly". He was accused of spying for Indian intelligence agency, the Research and Analysis Wing, and aiding separatist elements in restive Balochistan.
His execution was stayed last week by the ICJ, which on Monday heard arguments presented by both the sides.
A panel of 11 judges today heard both India and Pakistan on Kulbhushan Jadhav, who was arrested past year and then convicted of spying by a Pakistani military court, which sentenced him to death. India had been provided with the copy of passport recovered from Jadhav.
"The procedural safeguards are greater when the charges are as serious as capital punishment".

Other sectors losing jobs over the month were manufacturing; information; financial activities; other services; and government. The unemployment rate for April returned to 5.7 per cent, where it has been for most of the past 18 months.

India, on the other hand, highlighted the "grave" situation in the case and that Jadhav, who has been denied all chances of defending himself, could be hanged in Pakistan even before India could argue its case.
"He (Jadhav) acquired premature retirement from the Indian navy and since then the government has nothing to do with him", said Vikas Swarup, a spokesperson for the Ministry of External Affairs, requesting Pakistan to grant counsellor access to the "arrested Indian citizen".
Lawyers for New Delhi urged the International Court of Justice to halt the execution of Kulbhushan Sudhir Jadhav.
It said India had no grounds for relief since the ICJ was not a criminal court of appeal. Pak's agent Dr. Mohammad Faisal, who is Director General of South Asia and SAARC, played the terror card saying his country has been a victim of terrorism while accusing Jadhav to be an Indian spy out there to carry out more terror strikes in Pak.
"India has used this court as the scene of political theatre".
Earlier in his arguments, Pakistani Counsel Khawar Qureshi said India's allegation regarding kidnap of its spy is not true and he was arrested on Pakistani soil.
