"Plaintiffs have also personally witnessed the current and ongoing investigation into the unidentified gas sources, all of which has created a reasonable fear and apprehension in plaintiffs as to the safety of the residence".

The company that owns a gas well linked to a fatal home explosion in Colorado says it is permanently disconnecting other pipelines in the area like the one blamed in the explosion.

"At this point, it is impossible to say how many", Justino said in an email. A valve on the flowline, which was connected to the well, was open, investigators have said.

The April 17 explosion killed Mark Martinez and Joey Irwin, and left Erin Martinez traumatically burned.

The second claim for relief is based on negligence, alleging that Anadarko and Noble failed to confirm or monitor that it wasn't unsafe to activate the well, which thereby released gas into an abandoned flow line. The developers and builders had a duty to confirm that the lots were free of any "oil and gas related facilities, pipes or other hazards" related to oil and gas production, the lawsuit claims.

The lawsuit states the Baum family has suffered mental anguish and severe anxiety, post-traumatic stress as well as damages to their personal and real property.

Frederick-Firestone Fire Protection District Chief Ted Poszywak previously said investigators have deemed the neighborhood safe, saying that the tragedy was an "unusual and tragic set of circumstances". That includes Andarko, the company that owns the well, as well as Noble Energy which owned the well before Andarko. "Although, we recognize the concerns regarding property values, we do not discuss potential or pending litigation".
